These Terms & Conditions of use of our website, our applications or any products or services in connection with the Application, Website/products or any modes of registrations or usage of products, are between GyanSanchar (A Unit of Search and Learn Pvt Ltd.) and its users. These Terms and conditions are in accordance with the provisions of the Information Technology Act, 2000 and the Information Technology (Intermediaries guidelines) Rules, 2011 thereunder, as amended from time to time.

Please read the Terms and the Privacy Policy of the Company (“Privacy Policy”) with respect to registration with us, the use of the Application, Website, Services and products carefully before using the Application, Website, Services or products. In the event of any discrepancy between the Terms and any other policies with respect to the Application or Website or Services or products, the provisions of the Terms shall prevail.

Your use/access/browsing of the Application or Website or the Services or products or registration (with or without payment or subscription) through any means shall signify Your acceptance of the Terms and Your agreement to be legally bound by the same. If you do not agree with the Terms or the Privacy Policy, please do not use the Application or Website or avail the Services or products. Any access to our Services/Application/Services/products through registrations/subscription is non-transferable.

Except as mentioned below, all information, content, material, trademarks, service marks, trade names, and trade secrets including but not limited to the software, text, images, graphics, video, script and audio, contained in the Application, Website, Services and products are proprietary property of the Company. No Proprietary Information may be copied, downloaded, reproduced, modified, republished, uploaded, posted, transmitted or distributed in any way without obtaining prior written permission from the Company, and nothing on this Application or Website or Services or products shall be deemed to confer a license of, or any other right, interest or title to or in, any of the intellectual property rights belonging to the Company, to the User.

You may own the medium on which the information, content or materials resides, but the Company shall at all times retain full and complete title to the information, content or materials and all intellectual property rights inserted by the Company on such medium.

Your use of our products, Website, Application and Services is solely for Your personal and non-commercial use. Any use of the Application, Website, Services or products or their contents other than for personal purposes is prohibited. You may not decompile, reverse engineer, or disassemble the contents of the Application and/or our Website and/or Services/products, or modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information or software obtained from the Application and/or our Website and/or Services/products, or remove any copyright, trademark registration, or other proprietary notices from the contents thereof.

You will not:

• Use the Application, Website, or our products/Services for commercial purposes of any kind.
• Advertise or sell the Application or any products, Services or domain names, or solicit others for commercial purposes of any kind.
• Use the Application, Website, products or Services in any way that is unlawful or harms the Company or any other person or entity as determined by the Company.

No User shall be permitted to perform any of the following while availing our Services:

• Making available any content that is misleading, unlawful, harmful, threatening, abusive, tortious, defamatory, vulgar, obscene, hateful, or racially, ethnically or otherwise objectionable.
• Stalking, intimidating, harassing another, or inciting others to commit violence.
• Transmitting material that encourages a criminal offence, results in civil liability, or breaches any relevant laws or regulations.
• Interfering with any other person's use or enjoyment of the Application/Website/Services.
• Making, transmitting or storing copies of copyrighted materials without permission, or infringing any intellectual property or proprietary rights of anyone else.
• Making available content You do not have the right to share, unless You own the rights or have received all necessary consents.
• Impersonating any person or entity, or misrepresenting Your affiliation with one.
• Posting or transmitting viruses, trojans, worms, spyware, or other harmful code, or harvesting data or personal information about other Users without consent.
• Accessing or using the Application in any manner that could damage, disable, overburden or impair our servers or networks.
• Interfering with, disrupting, or violating any laws or policies related to access or use of the Application/Website/Services/products.
• Attempting to gain unauthorized access to user accounts, passwords, servers, or networks connected to the Application.
• Engaging in disruptive attacks such as denial-of-service attacks.
• Using deep-links, page-scraping, robots, spiders or similar automated methods to access, copy or monitor any portion of the Application without authorization.
• Altering or modifying any part of the Services.
• Using the Services for purposes not permitted by these Terms, applicable law, or generally accepted practices.

In the preparation of the Application/Website/Services/products and contents therein, every effort has been made to offer the most current, correct, and clearly expressed information possible. Nevertheless, inadvertent errors may occur, and the Company disclaims any responsibility for any such errors or inaccuracies. Company also reserves the right and discretion to make any changes/corrections or withdraw/add contents at any time without notice. Neither the Company nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on the Application/Website/Services/products for any particular purpose.

Our Website/Applications provide Users with access to compiled educational information and related sources. Such information is provided on an as-is basis and We assume no liability for the accuracy or completeness of such information. From time to time the Website may also include links to other websites, provided for convenience only; we have no responsibility for the content of the linked website(s).

The contents of the Website/Application/Services/products are developed based on the concepts covered in the structured curriculum syllabus prescribed for students of various courses. The usage of the Application/Services/products is not endorsed as a substitution to the curriculum-based education provided by educational institutions, but is intended to supplement the same by explaining and presenting concepts in a manner enabling easy understanding.

Subscription to the Application or usage of our Services/Website/products does not in any manner guarantee admission to any educational institutions, passing of any exams, or achievement of any specified percentage of marks in any examination.

Some parts of the Services are interactive, and we encourage contributions from Users, which may or may not be subject to editorial control prior to being posted. The Company accepts no responsibility or liability for any material communicated by third parties in this way, and reserves the right at its sole discretion to remove, review, edit or delete any content. We would not be responsible to verify whether any questions/answers or content placed by any User contain infringing material.

The Company may, based on any form of access to the Application (including free download/trials) or Services or Website or registrations through any source, contact the User through SMS, email and call, to provide information about our offerings and products, notifications on important updates, and/or to seek permission for demonstration of its products. The User expressly grants such permission and holds the Company indemnified against any liabilities in case the User's mobile number is registered with the Do Not Call (DNC) database.

By registering, you agree to make your contact details available to Our employees, associates, subsidiaries, affiliates and partners so that you may be contacted for education information, offerings and promotions through telephone, SMS, email etc. The Company shall have the right to monitor download and usage of the Application/Services/products to analyze usage, discuss it with the User/student, and enable effective usage of the Services — including clearing doubts, providing study plans, and mentoring the student, on the express consent of the legal guardian/parent where applicable.

The Company's products and/or Services are compatible only with certain devices/tablets/ instruments/hardware. The Company shall not be obligated to provide workable products and/or services for instruments not recognized by the Company. The Company shall have no responsibility for any loss or damage caused to any hardware, software, or instrument, including loss of data, resulting from Your use of our products and Services.

Refunds are applicable only on GyanSanchar Online Programs listed below.

Online Live Classes

The last day for refund is 7 days from the date of start of classes. A cancellation fee of 20% of fees will be charged. If the duration of online live classes is less than 30 days, no refund is applicable.

Refunds are not applicable for:

• Online Test Series
• Offline Test Series
• DIY (recorded) courses

Refunds for Offline Courses

• Refund is not applicable if a student stops attending classes without notification.
• In case of relocation, the student must submit relevant documents for verification; refund will be processed after deducting prorated fees, administrative, and study material charges.
• The same refund rules apply if a student joins after the start date, does not attend a single class, or applies for a refund before the class starts.
• Students may exchange their batch/phase (alternate starting date) by paying a nominal charge, settled before the request is processed.
• Students should connect with our support team for any refund or phase-change requests.

To access the Services and use the Application/products, you must register and maintain an account, furnishing information including your name, mobile number, email address, residential address, grade/class, and payment information where required. You are responsible for ensuring this information is accurate, complete and current, and for maintaining the confidentiality of your account. You agree to log out at the end of each session and immediately notify the Company of any unauthorized use of your account.

If there is reason to believe there is a breach of security or misuse of your account, we may request a password change or suspend your account, without liability to the Company. The Company cannot guarantee accessibility to the Application at all times, and shall not be liable for damages arising from Your inability to log in or access the Services.

Persons who are ‘competent/capable’ of contracting within the meaning of the Indian Contract Act, 1872 shall be eligible to register for the Application and Our products or Services. Minors and un-discharged insolvents are not eligible to register directly. If a minor wishes to use Our products or Services, such use shall be made available by their legal guardian or parent, who has agreed to these Terms. It is assumed that a minor using the Application has obtained the consent of their legal guardian or parent.

The Company reserves the right to terminate Your subscription/Services and/or refuse access if it is discovered that You are under 18 years of age and consent from a parent/legal guardian was not obtained, or if any information provided is inaccurate. Any person under 18 should seek the consent of their parents/legal guardians before providing any information about themselves, their parents, or family members on the Application.

You agree to defend, indemnify and hold harmless the Company, its officers, directors, employees and agents from and against any claims, damages, losses, liabilities, costs or expenses (including attorney's fees) arising from Your use of the Application/Website/Services, Your violation of these Terms or any Company policy, Your violation of any third-party right, or any claim that Your use has caused damage to a third party.

In no event shall the Company, its officers, directors, employees, partners or agents be liable to You or any third party for any special, incidental, indirect, consequential or punitive damages arising out of, or in connection with, Your use of or access to the Application.

This website, the application and the services are provided on an ‘as is’ basis with all faults and without any warranty of any kind. The Company disclaims all warranties and conditions with regard to the website, application/products and services, including all implied warranties and conditions of merchantability, fitness for a particular purpose, title, accuracy, timeliness, performance, completeness, suitability and non-infringement. Your use of any information or materials on the website/application/services/products is entirely at Your own risk, for which we shall not be liable.

The Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. The Company has the right to change, modify, suspend, or discontinue any aspect of the Application or Services at any time without notice, and to amend these Terms from time to time without prior notice. All prices are subject to change without notice.

• Notice: All notices from the Company shall be provided via email to Your account or as a general notification on the Application. Notices to the Company should be sent to support@gyansanchar.com.
• Entire Agreement: These Terms, along with the Privacy Policy and any applicable guidelines, constitute the entire agreement between the Company and You.
• Assignment: You cannot assign or transfer Your obligations under these Terms to any third party. The Company's rights are freely transferable without requiring Your consent.
• Severability: If any provision of these Terms is found unenforceable, it shall be enforced to the maximum extent permissible, and the remainder shall continue in full force and effect.
• Waiver: Any failure by the Company to enforce any provision shall not constitute a waiver of that provision or right.
• Relationship: Your participation on the Application does not make You an employee, agent, partner, joint venturer, or franchisee of the Company.
• You consent to GyanSanchar having the exclusive right to use your information for GyanSanchar's marketing and publicity purposes, including in case of your selection in competitive entrance exams or any other examination (national or international).
• Feedback: Any feedback You provide is deemed non-confidential, and the Application is free to use it on an unrestricted basis without compensation to You, unless specified otherwise.
